On October 19th, we held the 10th Llach Serra Forum<\/strong>, a session dedicated to analyzing the main challenges of the rental market and reflecting on how to build healthy landlord-tenant relationships between owners and tenants.<\/p>\n\n

With this session, held at the Casal de Vilafranca del Pened\u00e8s, we have kicked off the 4th Llach Serra Forum cycle<\/strong>, a space for debate and dissemination that continues to focus on rigorous knowledge and the exchange of experiences within the real estate and housing sector.<\/p>\n\n

On this occasion, the conversation focused on an essential idea: a good landlord-tenant relationship depends not only on contract compliance but also on clarity, balance, trust, and the ability to anticipate potential conflicts.<\/p>\n\n

The Importance of Preventing Conflicts<\/h2>\n\n

One of the main ideas of the day was that the best way to resolve a conflict is to prevent it from occurring in the first place.<\/p>\n\n

Many discrepancies between owners and tenants do not originate from major legal issues, but rather from poorly managed everyday situations, a lack of information, or differing expectations regarding rental conditions.<\/p>\n\n

During the Forum, the importance of establishing clear foundations from the very beginning was highlighted, properly explaining the rights and obligations of each party and avoiding taking for granted aspects that could generate misunderstandings in the future.<\/p>\n\n

A healthy landlord-tenant relationship begins before the contract is signed.<\/strong><\/p>\n\n

Clear Contracts Without Unfair Clauses<\/h2>\n\n

One of the central points of the session was the need to ensure that lease agreements are transparent, understandable, and compliant with current regulations.<\/p>\n\n

Different examples of void or unfair clauses that can generate conflict were addressed, such as passing on certain expenses without specifying the amount, excessive demands regarding the state of the property at the end of the contract, or obligations that do not legally correspond to tenants.<\/p>\n\n

Emphasis was also placed on the importance of providing all necessary information before formalizing the rental, including a draft of the contract so that the parties can review it calmly and resolve any doubts.<\/p>\n\n

Contractual transparency is not only a legal obligation but also a fundamental tool for building trust.<\/p>\n\n

Clear Expectations from the Start<\/h2>\n\n

Another highlighted aspect was the importance of aligning the expectations of both owners and tenants.<\/p>\n\n

What is the actual state of the property at the time of delivery? Who is responsible for minor repairs? What responsibilities belong to each party? Under what circumstances might there be a need to recover the property? <\/p>\n\n

These questions, which may seem obvious, are often the source of disagreements when they have not been correctly explained.<\/p>\n\n

During the session, the advisability of reviewing the state of the property before moving in was emphasized, checking the operation of facilities and clarifying conservation and maintenance conditions.<\/p>\n\n

Similarly, it was noted that normal wear and tear resulting from ordinary use of the home cannot be equated to damage caused by improper use.<\/p>\n\n

Correctly defining the expectations of both parties is essential to avoid conflicts during the contract and at the time of its termination.<\/strong><\/p>\n\n

Communication and Empathy are Also Part of Good Management<\/h2>\n\n

Rental management does not end with the signing of the contract. Throughout the landlord-tenant relationship, incidents, doubts, or situations may arise that require an appropriate response. <\/p>\n\n

In this sense, the Forum highlighted the importance of attending to requests diligently, maintaining fluid communication, and acting with empathy.<\/p>\n\n

A breakdown, a repair, or a sensitive personal situation can turn into a conflict if not addressed correctly. Therefore, knowing how to listen, providing a response, and choosing the most appropriate communication channel is just as important as knowing the regulations. <\/p>\n\n

Professionalism in real estate management is also demonstrated in the way people are supported and solutions are found for everyday situations.<\/p>\n\n

A Professional Perspective on the Rental Market<\/h2>\n\n

The 10th Llach Serra Forum featured the participation of Rub\u00e9n Llach<\/strong>, managing partner of Llach Serra & Associats and moderator of the session; Joan Rodr\u00edguez<\/strong>, Head of Housing at the Alt Pened\u00e8s County Council; and Jordi Pujol\u00e0<\/strong>, Director of Asset Management at Llach Serra & Associats.<\/p>\n\n

The session approached rentals from the perspective of real estate management, legal knowledge, and the experience of professionals who work daily with owners and tenants.<\/p>\n\n

A meeting that allowed real situations, best practices, and reflections on how to foster more balanced landlord-tenant relationships to be brought to the table, in a context where access to housing and regulatory changes occupy a central place in social debate.<\/p>\n\n
